LIMITED WARRANTY AND WARRANTY DISCLAIMER

R-Kay Performance warrants to the Original Purchaser that each new product will be free from defects in material and workmanship when used under normal and appropriate conditions. This Limited Warranty covers a period ranging from 3 months to 1 year from the date of purchase, depending on the specific product. This warranty duration reflects R-Kay Performance’s dedication to quality and customer satisfaction within the respective warranty timelines. For the exact warranty period applicable to your product, please refer to the product documentation or contact R-Kay Performance customer service.

Please note the following:

  1. Warranty applies to purchases made on the R-Kay Performance website (r-kayperformance.com).
  2. Only the original purchaser is eligible for warranty coverage.
  3. Proof of purchase must be provided for any warranty claim.
  4. Approved warranty returns should be sent to R-Kay Performance within 7 days; contact us for possible extensions.

Exceptions to the Warranty

For clarity and without limiting the scope, the following conditions do not constitute defects in material or workmanship:

  1. Normal wear and tear or required maintenance that occurs during regular use.
  2. Damage resulting from improper handling, storage, mounting, installation, lubrication, or failure to perform necessary maintenance.
  3. Damage caused by misuse, abuse, unauthorized modifications or alterations, accidents, acts of nature, or external forces.
  4. Cosmetic damage, including but not limited to nicks, bruises, and discoloration that do not impact the product’s functionality.

EXCEPT WHERE PROHIBITED BY LAW, THIS WARRANTY IS EXCLUSIVE AND THE ONLY WARRANTY APPLICABLE TO THE PRODUCT. IT IS OFFERED EXPRESSLY IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ALL OF WHICH ARE DISCLAIMED.

In jurisdictions where the disclaimer of implied warranties is not permitted, such implied warranties are limited to the specific product warranty period.

LIMITED REMEDIES If the product exhibits a defect in materials or workmanship within the Limited Warranty Period, R-Kay Performance will provide a replacement for the product. R-Kay Performance will cover the cost of parts for the replacement at no charge to the customer. However, the customer is responsible for any labor costs associated with the removal and installation of the product. Additionally, the customer must bear and prepay all shipping or transportation expenses related to the warranty service, including returning the product to R-Kay Performance. The risk of loss or damage to the product during transit remains with the customer until the product is received by R-Kay Performance. Subject to applicable law, these remedies are exclusive and constitute the customer’s sole recourse in the event of a defect.

INCIDENTAL AND CONSEQUENTIAL DAMAGE DISCLAIMER EXCEPT AS REQUIRED BY LAW, R-KAY PERFORMANCE DISCLAIMS LIABILITY FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OR LOSSES ARISING FROM THE USE, MISUSE, OR INABILITY TO USE THE PRODUCT. THIS EXCLUSION ALSO APPLIES TO BREACHES OF WARRANTY, BOTH EXPRESS AND IMPLIED. R-KAY PERFORMANCE’S LIABILITY WILL NOT EXCEED THE PRODUCT’S PURCHASE PRICE, REGARDLESS OF THE NATURE OF ANY CLAIM.

General Conditions

  • All warranty work must be carried out by an approved mechanic by our team.
  • The warranty includes the replacement of parts and the cost of shipping.
  • In the case of a claim for a damaged frame, the frame or complete item (cleaned) must be sent to R-Kay Performance for examination. We reserve the right to charge for any labor and/or delivery and collection. Height limit marks on the seat post must be strictly adhered to. If there is no mark on the seat post, contact R-Kay Performance at sales@r-kayperformance.com. for advice.
  • Your warranty will be void if you elect to repair a defective product yourself or if you use a replacement part that is not supplied by R-Kay Performance or the manufacturer directly.
  • R-Kay Performance will not be liable for any damage, failure, or loss caused by the use of unauthorized components.
  • Disassembling any part or component beyond what is shown in the User Manual will void the warranty on that item and any other components that we determine are affected by such disassembly.
  • Bypassing or attempting to bypass the speed limiter set to 25km/h (15.5mph) will void the warranty.

General Maintenance

All items need regular servicing, and we always recommend a service in the first 6 weeks of use, especially when purchasing online, where the customer may need to perform some assembly. After this, if you are using your product daily, we recommend a service every 6 months for your safety and proper maintenance. We strongly recommend having the item serviced, ideally by an electric specialist, at least once a year after the first service.

It is also important to keep your item clean and well-lubricated.  If you use your item off-road, it is important to clean all mud and sand from moving parts and lightly lubricate them before storage or further use. Ensure no lubricant is applied to braking surfaces! A buildup of mud and/or sand on moving parts may damage your item and, in extreme cases, could void your warranty.

Nothing in the above affects your statutory rights.
